FACTS & ALLEGATIONS On March 4. 1999, plaintiff lose Tirado, 31, a truck driver, made a delivery of sheet rock at City Lumber Inc.'s warehouse in Long Island City Gina N.Y. After the delivery was complete, he was kneeling the warehouse floor folding a tarp. While he was so engage, one of the warehouse employees driving a forkaft struck him. The employee was carrying two pallets of 45 sheets of 2.75inch plywood, which blocked his view forward. The plywood struck Tirado and the forklift ran over his left foot.

Tirado sued City Lumber Inc. He claimed that the forklift driver was negligent in driving with his forward visibility blocked. Tirado argued that industry practice is to drive in reverse, with the load trailing. when the load on the forks blocks the driver's forward view.

INJURIES/DAMAGES amputation, below-the-knee; loss of'services

Tirado sustained severe crush injuries to his left foot with extensive degloving. He was taken to Bellevue Hospital, where he underwent three surgeries. Skin grafts were taken from his right thigh. He was confined to a wheelchair for five months. The foot never became weight bearing because the grafts would break down and cause infections. There was ongoing pain. Eventually Tirado underwent a below-the-knee amputation.

Tirado was also hospitalized for psychological problems three times. There were two attempts at suicide. His spouse, Adriana, brought an action for loss of services.

RESULT This case settled during the fifth day of the liability trial, after the parties rested, for $4.4 million. In addition, pursuant to Workers' Compensation Law § 29, one-third of a lien of approximately $220,000 was waived.
